Please read these Terms of Service carefully before using our services.
1. Acceptance of Terms
By accessing or using Westholme Park services, website, or any applications made available by Westholme Park (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Eligibility
You must be at least 18 years old to enter into a binding agreement with Westholme Park. If you are under 18, you may only use our Services with the involvement and consent of a parent or guardian. Certain properties may have additional eligibility requirements, such as student status verification.
3. Account Registration
To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Lease Agreements
All housing accommodations are subject to a separate lease agreement. The terms of your lease agreement will govern your tenancy and use of Westholme Park properties and facilities. In the event of any conflict between these Terms and your lease agreement, the terms of your lease agreement will prevail.
5. Application Process
Application for housing is subject to approval based on various factors including, but not limited to, availability, credit history, criminal background check, income verification, and rental history. Application fees are non-refundable regardless of approval status. We reserve the right to deny any application at our discretion.
6. Payment Terms
You agree to pay all fees and charges associated with your account and lease agreement in a timely manner. Payment methods accepted and payment schedules are detailed in your lease agreement. Late payments may result in additional fees as specified in your lease agreement.
7. Use of Services
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
- To impersonate or attempt to impersonate Westholme Park, a Westholme Park employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm Westholme Park or users of the Services
8. Property Rules and Regulations
Residents must comply with all property rules and regulations as outlined in the lease agreement and any additional rules provided during move-in. These rules are designed to ensure the safety, comfort, and enjoyment of all residents and may cover areas such as noise restrictions, guest policies, and use of amenities.
9. Maintenance and Repairs
Westholme Park is committed to maintaining safe and comfortable living environments. Residents must promptly report any maintenance issues or needed repairs through the designated channels. Emergency maintenance services are available 24/7 for urgent issues.
10. Termination
Termination of your lease agreement is governed by the terms specified within that agreement. Westholme Park reserves the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms.
11. Limitation of Liability
In no event shall Westholme Park, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use of the Services, including any direct, indirect, special, incidental, consequential, or punitive damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless Westholme Park, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees.
13. Changes to Terms
Westholme Park reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state where the property is located, without regard to its conflict of law provisions.
